Industrial designs and models Certificate of registration or renewal: Official document which reproduces the design and industrial model, the name of the filing person or company, the agent (if necessary), the subject of the design and industrial model, the number of designs or industrial models, and the references of the priority rights (if necessary). Creator: Individual who has made an innovative design or industrial model. Filing minutes : Official document which mentions the name of the filing person or company, the agent and the creator (if necessary), the designation of the object of the design and industrial model, the number of designs or model industrials, references of the priority rights (if necessary), the documents attached to the request and the amount of the fees paid. Filing person or company: Holder of the registered designs or industrial models. Industrial design: Assembly of lines or colors provided that this assembly or this form gives a special appearance to an industrial or artisanal product and may be used as model for the manufacture of an industrial or artisanal product. Industrial model: Plastic shape, associated or not to lines or colors, provided that this assembly or this shape gives a special appearance to an industrial or artisanal product and may be used as type for the manufacture of an industrial or artisanal product. Instruction: Specific way of accomplishing a task. Law 17/97: Law relating to industrial property in Morocco in force since December 18, 2004. Law 31/05: Law supplementing and amending Law 17/97 relating to industrial property, published on 20/02/2006. Locarno Classification: International classification intended for the registration of the designs and national and international industrial models. It is made up of 99 classes and subclasses. It makes it possible to refer to a single classification system. National Register of Designs and Industrial Models: Collection gathering all the history of the filings of designs and industrial models. Official catalog: Official collection published by OMPIC and grouping together all the requests for designs and industrial models. Priority: Time granted to the person filing a design or industrial model who has made a filing or not at the national level, to carry out the extension of the protection of the said design or industrial model in other countries. This time is 6 months for the designs and industrial models. Request for continuation of procedure: Request which allows the persons filing patents for designs or industrial models in the event of non-observance of the 3-month deadline for regularization of the situation, to regularize their request during a 2-month period running as from the expiry of the aforesaid times. Renewal: Operation which is used to renew the filing of a design and industrial model filed for a new 5-year period, and this through the payment of the renewal fees which are due. Transfer: The holder of a design or model may transfer the property of such design or model to any person or entity. However, with regard to third parties, the transfer has effect only when it is registered and enrolled in the National Register of Designs and Industrial Models. It is made based on a written request from one of the parties, accompanied by an authenticated or notarized instrument of transfer. Likewise, the design or industrial model, as an intangible asset, may change holders by way of succession on behalf of one or several heirs. - License :
The holder may grant user licenses of his design or industrial model on behalf one or more people by allowing them its use in an exclusive or non exclusive way. In this case, the ownership over of the design or model always remains in the name of the person who has filed the patent. The license is registered with the National Register of Designs and Industrial Models for enforcement against third parties and is made based on a written request from one of the parties, accompanied by a legalized or authenticated deed of transfer. - Change of the name and/or address of the holder:
The change of name and/or address of the holder is registered with the Register of Inscriptions of Designs and Industrial Models based on a written request from the filing company or individual accompanied by a document attesting the change. - Waiver:
The renunciation to the protection of the design or industrial model is registered in the National Register of Designs and Industrial Models. It may be made following a request made from the holder himself (voluntary deletion).
