Domain names

A domain name is an Internet address, used for a Web site. Increasingly, the domain name has become a distinctive sign for a company.
There might be conflicts between trademarks and domain names. Thus, if you choose a domain name already used by a registered trademark, you may be convicted for infringement of the rights over the trademark. By the same token, if your trademark is used in an illicit way as a domain name by a third party (one speaks here of "cybersquatting"), you may enforce your rights.

The charter for the naming of the .ma domain provides - for the resolution of litigation between a domain name and a trademark - for the recourse to an administrative procedure, managed by the WIPO Mediation and Arbitration Center, for the settlement of litigations related to domain names. If you do not manage to settle the litigation amicably by this means, you may start a legal action.
