How to choose a commercial name or a corporate name

Your denomination must be distinctive

  • It must be distinguished easily from the other companies working in the same sector. You may use a word or group of existing words, an invented word, a family name or a first name, initials, a group of characters, etc
  • At the same time as your commercial name it is possible to register an acronym, corresponding to the initials of the words composing your denomination.
  • You may choose a denomination which describes with accuracy your commercial activity, but it is not an obligation.

Caution: the commercial name and the trademark are not necessarily identical. You may choose to be original and creative through your trademark, which will be more exposed to scrutiny fro your customers, rather than in your denomination. In both cases, do not forget to register your trademark so that it is protected.

Your denomination should not lend itself to confusion

  • In order to get a negative certificate issued, it is necessary to seek if the name is not already used in the activity which you want to exercise. You may explore OMPIC's database of existing trade descriptions. (Link towards SIPIC). To that end, you use the Moroccan Nomenclature of Activities (NAM), which codifies the activities declared.
  • the commercial name that you choose should not cause confusion with an existing trademark. You must thus also carry out searches in the Trademarks database (link towards SIPIC) before choosing your denomination.
  • Your denomination should not either let people believe that you are a public organization, or that you are partner of an international organization. Thus avoid adjectives such as "legislative", or "official", "international", or "royal", for example.

Your denomination should not include any unacceptable term.

It is forbidden to use words which are vulgar, contrary to law and order and good morals, or terms suggesting that your company offers services which are obscene, scandalous or immoral.
